  17. <p>     Street person Richard Kreimer won national attention--and a
  18. potful of cash--when he sued the public library in
  19. Morristown, N.J., over a patron code of conduct that banned
  20. homeless people with poor personal hygiene. But the self-styled
  21. "homeless Ralph Nader" found himself barred from the building
  22. once again last week when a federal appeals court in
  23. Philadelphia overturned his victory and upheld the right of
  24. public libraries to expel vagrants in certain circumstances. A
  25. lower court had said the rules were an infringement of Kreimer's
  26. First Amendment rights, but the three-judge appeals panel
  27. disagreed. Although the library is a public forum, it "need not
  28. be used as a lounge or a shelter," wrote Judge Morton I.

  31. <p>     Kreimer became a minor celebrity when he took Morristown
  32. to court in a separate action over alleged police harassment.
  33. Although town officials denied the charges, they settled his
  34. case for $150,000 rather than engage in a protracted and costly
  35. court action. Kreimer received an additional $80,000 payment two
  36. months ago from the library's insurance company, which chose to
  37. settle his claim before the appeals court issued its ruling.
